This Privacy Policy (hereinafter “Policy”) provides information on how personal data is processed and how the privacy and information of users (hereinafter “Usuario”) of the website www.valfondo.com (hereinafter “Website”) is protected.

Valfondo reserves the right to modify this Policy whenever necessary, in any case guaranteeing the right of the website’s users to be duly informed.

In compliance with the provisions of the General Data Protection Regulation, Organic Law 3/2018 of 5 December on the Protection of Personal Data and Guarantee of Digital Rights, and Law 34/2002 of 11 July, on Information Society Services and Electronic Commerce, VALFONDO informs the User of the following:

1. Type, purpose, legitimate basis for the processing and storage of personal data

a) Merely browsing the Website will not involve the processing of your personal data, apart from, in specific cases, your IP address and browsing-related data, for the purpose of managing and optimising the same and analysing how the User interacts with the Website’s content, all of which is in accordance with the terms and conditions contained in the COOKIES POLICY, and with the interested party’s consent being the basis for legitimising this processing of personal data.

b)  Attending to the communications made by the User to the professional contact channels provided on the Website, as well as requests for the exercise of rights and complaints made through the contact channels provided for this purpose, will entail the processing of the personal data provided by the User and that which, for the communication’s correct processing, is necessary for the purposes described (e-mail, telephone or postal address, as well as any other data that the User freely decides to provide and which, as we do not know the content of all the possible communications that the User may send us, we cannot detail).

The processing of personal data carried out to reply to communications made by the User through the professional contact channels provided on the Website and to attend to the exercise of the rights described in this policy are legitimised by the User’s consent and the legitimate interest of Valfondo in replying to said communications. They shall be deleted within a period of two years.

The processing of personal data carried out in response to complaints is legitimised by the data controller’s legitimate interest and will be kept for 7 days unless they are to be investigated, in which case they will be kept for the duration of the investigation, the corresponding legal proceedings or the prescription period of any actions that may be brought.

2. How do we share information with third parties?

We share personal information with third parties in order to fulfil the purposes stated in this Policy or when we believe that we are permitted or required to do so by law. When we share personal information, we do so in accordance with data privacy and security requirements.

Valfondo informs the interested party that some of our suppliers may process their personal data as data processors, for example, in the case of:

a) Third-party service providers, when necessary for the provision of services, internal management, software, system and platform support, cloud hosting services and electronic communications. In such cases, access to your data by third parties will only take place when Valfondo maintains a contractual relationship with the data processor that guarantees confidentiality, non-use of the User's personal information that we make available for purposes other than those indicated above, as well as compliance with our internal privacy and information security regulations.

b) When said transfer of data is covered by a legal obligation or is required by the competent authorities in order to meet legal requirements, criminal investigation of possible illegal activity or claims that content infringes the rights of third parties or to protect the rights, property or security of third parties, in the event of merger, sale, restructuring, acquisition, joint venture, assignment, transfer or other disposal, in whole or in part, of our business, assets or shares (for example, transfers to the Spanish tax agency, social security treasury...).

c) VALFONDO may also transfer information to its companies (subsidiaries) and partners for business management purposes.

3. International transfers. In some cases Valfondo uses third-party tools and services for managing services.

VALFONDO does not carry out international transfers of personal data as it uses safe tools whose servers are preferably located in Spain, or failing this, in a member state of the European Union, or which comply with the European laws in light of the guidelines and recommendations of the Spanish Data Protection Agency, the European Commission and the community agreements of reference with respect to the international transfer of data.

4. Exercise of rights and claims before the Spanish Data Protection Agency.

In this case, the User shall indicate the right they wish to exercise by attaching a copy of their ID card or any other valid identification document that legitimises them to do so, including that which allows their electronic identification.

In the event that your rights are not effectively met, you may make a complaint to the Spanish Data Protection Agency.

5. Your commitment, the authenticity of the data you provide.

The user declares that the personal data they provide to Valfondo is authentic.

As the User, you must be aware that you are solely responsible for any injury or harm, direct or indirect, which may be caused to Valfondo as the party responsible for this Website or to a third party if you send us false data or data belonging to third parties without their prior consent resulting in fraud, injury or harm.

To keep your data up-to-date and accurate, the User is requested to notify any changes which may occur to the data provided.

6. Consent of minors

It is forbidden for users under 14 years of age to send personal data through this website or the channels indicated therein. In the event that Valfondo detects users who may be under the aforementioned age, it will not process their data and will not respond to their requests.

Valfondo reserves the right to request a copy of your ID or equivalent document which accredits your legitimacy in the event of well-founded suspicions of the User’s underage status.

7. Applicable security measures

In order to protect Users’ personal data, Valfondo ensures and controls its data controllers, in the application of the technical and organisational measures in line with the state of the art in order to protect personal data, taking into consideration the scope, context and purposes of the processing, and the risks of probability and severity variables for the rights and liberties of the interested parties, ensuring it is able to guarantee the confidentiality, integrity, availability and resilience of the processing systems and services.

Our information security policies and procedures are reviewed and updated regularly in order to meet the needs of the business, technological changes and regulatory requirements.

8. Applicable law and jurisdiction

Valfondo is based in Spain, and therefore the content of this Privacy Policy has been drafted by virtue of Spanish legislation and the applicable regulations of the European Union.

By accepting this Policy, the user agrees that claims or complaints against Valfondo resulting from or relating to this website’s use, and more specifically with the processing of your personal data, will be resolved by the courts of the competent jurisdiction in Zaragoza. Should Valfondo itself be required to make any type of complaint, it will do so before the competent courts at the User’s address or Valfondo’s address (Calle Felipe Sanclemente 26, 3o, 50001-Zaragoza) in the case of legal entities or non-consumer professionals.

If the User accesses this website from outside Spain, they are responsible for complying with all applicable local and international laws.
